COSTS & OTHER INFORMATION
1. RESIDENTIAL CONVEYANCING* (e.g. house & flat)
Our estimated legal fees, exclusive of VAT, for purchase* or sale of residential properties (not commercial or mixed residential/commercial), with up to two buyers, only one title involved, title registered at Land Registry and vacant possession on completion, are:-
- £0 / Gift to £100,000 = £750.00 - £600,001 to £700,000 = £1,750.00
- £100,001 to £200,000 = £850.00 - £700,001 to £800,000 = £2,050.00
- £200,001 to £300,000 = £950.00 - £800,001 to £900,000 = £2,450.00
- £300,001 to £400,000 = £1,050.00 - £900,001 to £1,000,000 = £2,850.00
- £400,001 to £500,000 = £1,250.00 - £1,000,001 upwards – To be quoted on request
- £500,001 to £600,000 = £1,450.00
(*NB: No new instructions accepted for residential purchases from 01.10.2023)
Please note the following information and estimated EXTRA FEES:-
1.1 For all cases:
- VAT (current rate 20%) is payable in addition to all fees and charges, where applicable;
- Disbursements (fees payable to third parties):
- For all cases - Client’s Identity Check fee (£15 per person) and ID search administration fee (£5 per person);
- For purchase* - Survey or valuation fees; specialists’ inspection fees; conveyancing search fees (such as Local, Environment & Mining, Water & Drainage, Chancel, HS2 and Fracking); Stamp Duty Land Transaction Tax; Land Registry search and registration fees; freeholder/landlord’s agents’ notice, administration and/or legal fees; lender’s administration, arrangement, legal and/or its bank transfer fees; mortgage brokers’ arrangement fees, indemnity insurance policy premium and other necessary fees.
- For sale - Selling agents’ commission; Energy Performance Certificate fees; ground or chief rent; indemnity insurance policy premiums; missing document replacement fees; (For Flats) management company’s information pack and administration fees, estate charges and service charges; and
- For court cases - Barrister’s fees, expert’s fees, laboratory fees and witness’s fees.
- General Expenses (overheads which are treated as additional profit costs):
- For all cases - Office Administration Charges £20; bank transfer fee £30 (per remittance); postages/telephone/fax/photocopying/stationery charges £25; travelling expenses (at £0.95 per mile); bank’s cash handling fees (at £0.80 per £100); Post Office/DHL administration charges £10 (per trip) and colour photocopying charges (at £0.50 per A4 size sheet).
- Others:
- Any subsequent change of name, address, price and/or other details – From £80 per change.
- Any additional identity and address checks for overseas clients – From £80 per person.
- Notes:
- All sums quoted are (1) provisional only and are subject to all necessary changes from time to time with prior notice given whenever possible, and (2) subject to our Terms and Conditions of Business as published in our website.
- We do not offer any fixed price service and/or any “No completion no pay” service. We charge for all work done, whether completion takes place or not.
- If any of the parties is a limited company, additional legal fees are chargeable since there is more work to be done.
1.2 For purchases* (with one title and up to two buyers only):-
- Anti-Money Laundering (“AML”) Checks for sources of wealth and funds – From £180 per money handler.
- Preparation and submission of Stamp Duty Land Transaction Return to HMRC – From £80 per return.
- Preparation and submission of application to Land Registry for change of ownership of registered land – From £80 per registered title.
- Mortgage work for the lender and the buyer if the Property is to be mortgaged as security, including registration of the Legal Charge at Land Registry – From £350 per registered title and for up to two borrowers, whether or not we are acting for the lender at the same time.
- If the title, whether freehold or leasehold, is unregistered and the purchase is subject to compulsory first registration of title – From £250 per title for registration.
- If the purchase is a Buy-to-Let and it is subject to an existing tenancy agreement with no vacant possession given on completion – From £350 per title or tenancy agreement with up to 2 tenants.
- If the title is leasehold, whether registered or not, and it is a head lease without any sub-lease - From £250 per title.
- If the property is an off-plan and/or New Build – From £250 per title.
- If a notice of change of ownership and/or mortgage is required to be served on the landlord and/or its managing agent – From £120 per notice.
- If a Certificate of Compliance or Consent is required – From £150 per document.
- If it is a Help to Buy/Shared Equity/Shared Ownership purchase – From £300 per title.
- If buying a leasehold title, we must under our professional rules give you an initial report with advice on whether or not there is any unusually onerous provision in the lease. This is to enable you to withdraw at an earlier stage and save costs if such provisions are unacceptable to you and/or your lender – From £300 per lease, payable in addition to our legal fees for the purchase and/or mortgage work.
- If buying a freehold title subject to a rent charge, we must under our professional rules give you an initial report with advice on the rent charge provisions. This is to enable you to withdraw at an earlier stage and save costs if such provisions are unacceptable to you and/or your lender – From £300 per title, payable in addition to our legal fees for the purchase and/or mortgage work.
- If a General Power of Attorney is required, from £180 each.
- If a Deed of Covenant or Variation is required, from £250 each.
- If a Statutory Declaration is required for dealing with title, boundary or other issues, from £200 each.
- Purchase of freehold title – From £450 per title.
- Others – To quote on application.
1.3 For sales (with one title and up to two sellers only):-
- If the property is sold subject to an existing tenancy agreement with no vacant possession given on completion – From £350 per tenancy agreement for up to 2 tenants.
- If any mortgage or legal charge is to be redeemed and cancelled at Land Registry – From £180 per registered title and £350 per unregistered title.
- If the title is leasehold, whether registered or not, and it is a head lease without any sub-lease – From £250 per title.
- If a management pack is required (for sale of a flat) – From £100 per pack from the management company and/or the managing agent.
- If any consent to sale is required from the landlord and/or its managing agent and/or if any deed of covenant is required – From £200 per consent application and/or deed of covenant.
- If a General Power of Attorney is required by the seller - From £180 each.
- If a Deed of Covenant or Variation is required - From £250 each.
- If the title is unregistered and the buyer requires compulsory first registration of title at Land Registry before completion – From £300 per title.
- If there is any missing title deed, consent, ground/chief rent receipt, rent charge redemption certificate, indemnity insurance policy, planning permission, Building Regulations Approval or any other document reasonably required to be obtained by the buyer – From £180 per document (regardless of the outcome of the application).
- If any retrospective consent (not Planning Permission and/or Building Regulations Approval) is required from the freeholder or landlord for any unauthorised alteration or addition, e.g. conservatory, garage and extension – From £350 per application (regardless of the outcome of the application).
- If a Consent to Mortgage is required to be given by any non-owner adult occupier by the lender – From £350 per occupier, including, if required, suitable independent legal advice to be given to him, assuming there is no conflict of interests and he wishes us to give him such advice.
- If a Statutory Declaration is required for dealing with title, boundary or other issues, from £250 each.
- To deal with any unusual requirement under the lease, e.g. Landlord’s Consent to Insurance – From £250 per application (regardless of outcome).
- Others – To quote on application.
2. COMMERCIAL CONVEYANCING (e.g. business, shop, warehouse & land)
- Sale or purchase of business only – From £500 for consideration up to £100,000.
- Granting or taking a short lease of shop – From £800 for weekly rent up to £250 and term up to 3 years without security of tenure.
- Sale or purchase of property only - From £900 for consideration up to £150,000.
- Sale or purchase of both business and property - From £1,400 for total consideration up to £250,000.
- Granting or taking of a long lease of shop – From £1,200 for weekly rent up to £250 and term up to 15 years plus £200 if registration is required by Land Registry.
- Planning Application, Application for Lawful Development Certificate, Application for Variation of Planning Condition – From £1,500 per application.
- Others – To quote on application.
